"Tüccar" mobil oyununu ("Uygulama") indirerek, kurarak veya kullanarak bu Kullanım Şartları'nı ("Şartlar") ve ayrı bir belge olan Gizlilik Politikası'nı kabul etmiş sayılırsınız. Bu Şartları kabul etmiyorsanız Uygulamayı kullanmayınız.

By downloading, installing, or using the "Tüccar" mobile game ("App"), you agree to these Terms of Service ("Terms") and our separate Privacy Policy. If you do not agree to these Terms, do not use the App.

Tüccar, Osmanlı Yükselme Dönemi temalı, menü tabanlı bir mobil ticaret/hayat simülasyonu oyunudur. Oyun; ticaret, üretim, çok oyunculu düello ve etkinlikler gibi tek oyunculu ve çevrimiçi özellikler içerir. Hizmet "olduğu gibi" ve "mevcut olduğu ölçüde" sunulur; belirli özelliklerin sürekliliği garanti edilmez.

Tüccar is a menu-based mobile trading/life-simulation game set in the Ottoman Rise era. The game includes both single-player and online features such as trading, production, multiplayer duels, and events. The Service is provided "as is" and "as available"; continued availability of any specific feature is not guaranteed.

• Uygulamayı kullanmak için asgari yaş, bulunduğunuz ülkedeki dijital hizmetlere onay yaşıdır (Türkiye'de KVKK kapsamında genel olarak 13 yaş kabul edilir); 13 yaşından küçükseniz ebeveyn/veli izni gereklidir.
• Hesabınız açılışta anonim olarak oluşturulur; isteğe bağlı olarak Google veya Apple hesabınızla bağlayabilirsiniz. Hesabınızın güvenliğinden (cihazınız/oturumunuz) siz sorumlusunuz.
• Bir kişi/cihaz başına yalnızca bir hesap kullanılması beklenir; çoklu hesap açarak ekonomik avantaj/limit istismarı yasaktır (bkz. Bölüm 6).

• The minimum age to use the App is the digital consent age applicable in your country (generally recognized as 13 in Turkey under KVKK); if you are under 13, parental/guardian consent is required.
• Your account is created anonymously by default; you may optionally link it to your Google or Apple account. You are responsible for the security of your account (your device/session).
• Only one account per person/device is expected; creating multiple accounts to exploit economic advantages/limits is prohibited (see Section 6).

Size, Uygulamayı yalnızca kişisel, ticari olmayan eğlence amaçlarıyla kullanmanız için sınırlı, münhasır olmayan, devredilemez, geri alınabilir bir lisans veriyoruz. Uygulamanın yazılımı, tasarımı, grafikleri, sesleri, metinleri ve markası ("Tüccar") dâhil tüm fikri mülkiyet hakları hizmet sağlayıcıya veya lisans verenlerine aittir. Uygulamayı tersine mühendisliğe tabi tutamaz, kaynak koduna erişmeye çalışamaz, kopyalayamaz, dağıtamaz veya türev çalışma oluşturamazsınız.

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App solely for your personal, non-commercial entertainment. All intellectual property rights in the App — including its software, design, graphics, audio, text, and the "Tüccar" brand — belong to the service provider or its licensors. You may not reverse-engineer, attempt to access source code, copy, distribute, or create derivative works from the App.

• Uygulama içinde elmas, akçe ve çeşitli sanal eşyalar gibi sanal ürünler ("Sanal Ürünler") bulunur. Sanal Ürünler gerçek para karşılığında satın alınabilir veya oyun içi etkinliklerle kazanılabilir.
• Sanal Ürünler lisanslıdır, satın alınmaz — üzerlerinde hiçbir mülkiyet hakkınız yoktur, gerçek para değeri taşımazlar, nakde çevrilemezler, başka bir hesaba/oyuncuya devredilemezler ve hizmet sağlayıcının takdirine bağlı olarak değiştirilebilir, güncellenebilir veya kaldırılabilirler.
• Tüm gerçek-para ödemeleri Google Play Faturalandırma veya Apple App Store üzerinden gerçekleştirilir; iade/anlaşmazlık talepleri ilgili mağazanın politikalarına tabidir.
• Hesabınız Bölüm 9 uyarınca feshedilir/askıya alınırsa, satın alınmış olsun ya da olmasın, tüm Sanal Ürünlere erişiminizi kaybedebilirsiniz; bu durumda geri ödeme yapılmaz.

5.1. Otomatik Yenilenen Abonelik — Âyân Üyeliği

• Uygulama, Âyân Üyeliği adlı otomatik yenilenen bir abonelik sunar. Abonelik süresi 1 aydır (30 gün) ve abonelik, oyun içi ayrıcalıklar (günlük elmas, gelişmiş düello barı, hızlı enerji dolumu, geçiş reklamı muafiyeti ve benzeri) sağlar.
• Güncel fiyat, satın alma ekranında ve App Store / Google Play ürün sayfasında yerel para biriminizle gösterilir.
• Ödeme, satın alımı onayladığınızda mağaza hesabınızdan tahsil edilir. Abonelik, yürürlükteki dönemin bitiminden en az 24 saat önce iptal edilmediği sürece otomatik olarak yenilenir ve yenileme ücreti dönem bitiminden önceki 24 saat içinde tahsil edilir.
• Aboneliğinizi istediğiniz zaman cihazınızın hesap ayarlarından yönetebilir veya iptal edebilirsiniz (iOS: Ayarlar › Apple Kimliği › Abonelikler; Android: Google Play › Abonelikler). İptal, yürürlükteki dönemin sonunda geçerli olur; süresi dolmamış dönemin kullanılmayan kısmı için iade yapılmaz.
• Aboneliği iptal etmeniz, iptal tarihine kadar kazanılmış sanal ürünleri etkilemez; ancak abonelik süresi bittiğinde aboneliğe bağlı ayrıcalıklar sona erer.

• The App contains virtual items ("Virtual Items") such as gems, in-game currency, and various goods. Virtual Items may be purchased with real money or earned through in-game activities.
• Virtual Items are licensed, not sold — you have no ownership interest in them, they hold no real-world monetary value, cannot be redeemed for cash, cannot be transferred to another account/player, and may be modified, updated, or removed at the service provider's discretion.
• All real-money payments are processed via Google Play Billing or the Apple App Store; refund/dispute requests are subject to the respective store's policies.
• If your account is terminated/suspended under Section 9, you may lose access to all Virtual Items regardless of whether they were purchased, and no refund will be issued in that case.

5.1. Auto-Renewable Subscription — Âyân Membership

• The App offers an auto-renewable subscription called Âyân Membership. The subscription period is 1 month (30 days) and provides in-game privileges (daily gems, an enhanced duel bar, faster energy regeneration, exemption from interstitial ads, and similar benefits).
• The current price is shown in your local currency on the purchase screen and on the App Store / Google Play product page.
• Payment is charged to your store account upon confirmation of purchase. The subscription renews automatically unless it is cancelled at least 24 hours before the end of the current period, and the renewal charge is applied within 24 hours prior to the end of the current period.
• You can manage or cancel your subscription at any time in your device account settings (iOS: Settings › Apple Account › Subscriptions; Android: Google Play › Subscriptions). Cancellation takes effect at the end of the current period; no refund is provided for the unused portion of a period already paid for.
• Cancelling the subscription does not affect virtual items already earned; however, subscription-linked privileges end when the subscription period expires.

Aşağıdaki davranışlar kesinlikle yasaktır:

• Hile yazılımı, bot, script, oyun içi ekonomiyi manipüle eden istismar (exploit) kullanmak,
• Çoklu hesap açarak günlük ödül/etkinlik limitlerini aşmak,
• Uygulamanın sunucularına veya diğer oyunculara yönelik saldırı/aşırı yük (DoS) girişiminde bulunmak,
• Diğer oyuncuları taciz etmek, tehdit etmek veya rahatsız edici/müstehcen/nefret söylemi içeren rumuz, lonca adı ya da lokanta adı kullanmak,
• Hesabınızı veya sanal ürünlerinizi gerçek parayla üçüncü taraflara satmak/devretmek,
• Yürürlükteki yasaları ihlal eden herhangi bir davranışta bulunmak.

The following conduct is strictly prohibited:

• Using cheat software, bots, scripts, or exploits that manipulate the in-game economy,
• Creating multiple accounts to exceed daily reward/event limits,
• Attacking or attempting to overload (DoS) the App's servers or other players,
• Harassing or threatening other players, or using an offensive/obscene/hateful display name, guild name, or restaurant name,
• Selling or transferring your account or Virtual Items to third parties for real money,
• Engaging in any conduct that violates applicable law.

Uygulama; görünen isim, lokanta adı, lonca adı gibi diğer oyunculara açık kısa metinler girmenize izin verir ("Kullanıcı İçeriği"). Kullanıcı İçeriğinizin yürürlükteki yasalara ve Bölüm 6'daki kurallara uygun olmasından siz sorumlusunuz. Uygunsuz içerik tespit edilirse bildirmeden değiştirebilir, kaldırabilir veya sıfırlayabiliriz.

The App lets you enter short pieces of text visible to other players, such as your display name, restaurant name, or guild name ("User Content"). You are responsible for ensuring your User Content complies with applicable law and the rules in Section 6. We may modify, remove, or reset inappropriate content without prior notice.

Uygulama, Google AdMob aracılığıyla isteğe bağlı ödüllü reklamlar ve bazı geçiş noktalarında geçiş reklamları gösterebilir. Reklam içeriği üçüncü taraf reklamverenler tarafından sağlanır; bu içeriklerden hizmet sağlayıcı sorumlu değildir.

The App may display opt-in rewarded ads and, at certain transition points, interstitial ads via Google AdMob. Ad content is provided by third-party advertisers; the service provider is not responsible for such content.

Bu Şartları veya yürürlükteki yasaları ihlal ettiğinizi makul surette tespit edersek, hesabınızı önceden bildirimde bulunmaksızın askıya alabilir veya kalıcı olarak kapatabiliriz. Siz de dilediğiniz zaman Uygulama içi hesap silme özelliğini kullanarak veya Gizlilik Politikası Bölüm 15'teki adımları izleyerek hesabınızı kapatabilirsiniz.

If we reasonably determine that you have violated these Terms or applicable law, we may suspend or permanently close your account without prior notice. You may likewise close your account at any time using the in-app account deletion feature or by following the steps in Section 15 of the Privacy Policy.

Uygulama "OLDUĞU GİBİ" ve "MEVCUT OLDUĞU ŞEKLİYLE" sunulur. Yürürlükteki mevzuatın izin verdiği azami ölçüde, satılabilirlik, belirli bir amaca uygunluk ve ihlal etmeme dâhil ancak bunlarla sınırlı olmaksızın açık veya zımni hiçbir garanti vermeyiz. Uygulamanın kesintisiz, hatasız veya güvenlik açıklarından tamamen arındırılmış olacağını garanti etmiyoruz.

The App is provided "AS IS" and "AS AVAILABLE." To the maximum extent permitted by applicable law, we make no warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or completely free of security vulnerabilities.

Yürürlükteki mevzuatın izin verdiği azami ölçüde, hizmet sağlayıcı; kâr kaybı, veri kaybı veya sanal ürün kaybı dâhil olmak üzere hiçbir dolaylı, arızi, özel, cezai veya sonuç niteliğindeki zarardan sorumlu tutulamaz. Hizmet sağlayıcının Uygulamadan doğan toplam sorumluluğu, varsa, son 12 ay içinde Uygulama için fiilen ödediğiniz toplam tutarla sınırlıdır. Bu sınırlama, Türk hukukunun emredici hükümleri (ör. ağır kusur/kast hâlleri) saklı kalmak kaydıyla uygulanır.

To the maximum extent permitted by applicable law, the service provider shall not be liable for any indirect, incidental, special, punitive, or consequential damages, including loss of profits, data, or Virtual Items. The service provider's total liability arising from the App shall be limited to the total amount you actually paid for the App in the preceding 12 months, if any. This limitation applies subject to the mandatory provisions of Turkish law (e.g., cases of gross negligence or willful misconduct).

Bu Şartları ihlal etmenizden veya Uygulamayı yasa dışı ya da yetkisiz şekilde kullanmanızdan kaynaklanan her türlü talep, zarar, kayıp ve masrafa (makul avukatlık ücretleri dâhil) karşı hizmet sağlayıcıyı tazmin etmeyi kabul edersiniz.

You agree to indemnify the service provider against any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your breach of these Terms or your unlawful or unauthorized use of the App.

Uygulamayı Google Play veya Apple App Store üzerinden indirdiyseniz, ilgili mağazanın kendi kullanım koşulları da (Google Play Şartlar ve Koşulları / Apple Media Services Şartları) geçerlidir ve bu Şartlarla çelişki hâlinde, satın alma/faturalandırma konularında mağaza şartları önceliklidir. Apple cihazlar için ayrıca: Apple bu Uygulamanın bakım ve destek hizmetlerinden sorumlu değildir; bu Şartlar yalnızca sizinle hizmet sağlayıcı arasındadır, Apple bu Şartların bir tarafı değildir ancak üçüncü taraf lehtar olarak bu Şartları uygulama hakkına sahiptir.

If you downloaded the App from Google Play or the Apple App Store, that store's own terms (Google Play Terms of Service / Apple Media Services Terms) also apply, and in the event of conflict regarding purchases/billing, the store's terms take precedence. For Apple devices specifically: Apple has no obligation to furnish maintenance or support for the App; these Terms are between you and the service provider only, and Apple is not a party to these Terms but is a third-party beneficiary entitled to enforce them.

Bu Şartları zaman zaman güncelleyebiliriz. Önemli değişikliklerde uygulama içi bildirim veya mağaza sayfası güncellemesiyle sizi bilgilendiririz. Güncellemelerden sonra Uygulamayı kullanmaya devam etmeniz, güncellenmiş Şartları kabul ettiğiniz anlamına gelir.

We may update these Terms from time to time. For material changes, we will notify you via an in-app notice or a store listing update. Your continued use of the App after such updates constitutes acceptance of the updated Terms.

Bu Şartlar, Türkiye Cumhuriyeti kanunlarına tabidir ve bu kanunlara göre yorumlanır. Bu Şartlardan doğan her türlü uyuşmazlıkta İstanbul (Merkez) Mahkemeleri ve İcra Daireleri yetkilidir; tüketici sıfatınız bulunması hâlinde ilgili tüketici mevzuatı kapsamındaki yasal haklarınız (kendi yerleşim yerinizdeki tüketici mahkemelerinde dava açma hakkı dâhil) saklıdır.

These Terms are governed by and construed in accordance with the laws of the Republic of Turkey. The courts and execution offices of İstanbul (Merkez/Central) shall have jurisdiction over any dispute arising from these Terms; if you qualify as a consumer, your statutory rights under applicable consumer-protection law (including the right to bring proceedings in the consumer courts of your own place of residence) remain reserved.

Bu Şartların herhangi bir hükmünün geçersiz veya uygulanamaz sayılması, diğer hükümlerin geçerliliğini etkilemez. Hizmet sağlayıcının bir hakkını kullanmamış olması, o haktan feragat ettiği anlamına gelmez. Bu Şartlar ve Gizlilik Politikası, taraflar arasındaki anlaşmanın tamamını oluşturur.

If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect. The service provider's failure to exercise any right shall not constitute a waiver of that right. These Terms, together with the Privacy Policy, constitute the entire agreement between the parties.
